TENDER NOTIFICATION

TERMS AND CONDITIONS FOR SUPPLY OF

INDIAN AND FOREIGN BOOKS FOR THE YEAR 2008-09

 

Sealed tenders are invited for supply of Indian and foreign Medical Books, etc., on various subjects as per the list enclosed from the reputed medical books publishers / Distributors / Suppliers.  The terms and conditions are as follows:

 

1.      Cost of application Rs.2,000/- (Rupees two thousands only) should be sent by way of Demand draft in favour of the Director, Nizam’s Institute of Medical Sciences, Hyderabad, along with tender schedule.

2.      Earnest Money Deposit (EMD): Every intending tenderer has to furnish an EMD of Rs.25,000/- (Rupees twenty five thousand only) by paying cash at NIMS main cash counter or by way of demand draft drawn in favour of the Director, Nizam’s Institute of Medical Sciences, Hyderabad, along with tender schedule.  Unsuccessful tenderers will be refunded the EMD only after finalization of the tender.

3.      Security Deposit: the EMD of the successful Tenderer shall be treated as Security Deposit and this security deposit will be refunded only after supply of ordered books.  In case of breach of agreement, the EMD of successful tenderer shall be forfeited by the NIMS.

4.      Discount: The intended tenderer shall quote Uniform discount on all books of publisher’s original / special prices.  In case of short discount or no discount publications or society publications or government publications, it will be the responsibility of the book seller to give the same uniform discount on par with other publisher’s books.  The successful tenderer have to submit their bills which shall show the cost of the books in foreign currency and its equivalent in rupees as per the conversion rates and discounts.

5.      The Institute reserves the right to place the orders on one or more book suppliers.

6.      SUPPLY TIME: The successful tenderer shall supply the ordered Books of Indian publications and foreign publications within a period of one month and two months respectively failing which the order will be treated as cancelled automatically and his Security deposit shall be forfeited.   However the Library Committee, NIMS may accept the books supply after due date.

7.      If the successful tenderer fails to comply with the orders given for the supply of books, etc., within the time mentioned in point 6, which are in-print, will be debarred from supplying books to the NIMS library in future and action will be taken for breach of agreement.

8.      The tenderer shall be quoted: a) Name of the Author b) title, edition, year of publication, Publishers’ name c) foreign price and Indian price d) discount, e) price after discount in Indian rupees, etc.

9.      The successful tenderer has to supply latest Books of editions / publications.  However, if any new edition of a book announced during the time of supply the old edition cannot be accepted by the Institute.

10.  If new edition of any of the supplied books announced / released within 6 months from the date of supply, the supplier shall be replaced the new book by taking back of the older edition even though with the Library stamps are laid on book.  The difference amount will be paid by the Institute.

11.  PRICE & CONVERSION RATES: The price must be published / quoted, as the case may be.  Prices and Conversion rates are subject to change as per publishers latest catalogue and as per GOC as on date of billing.  The prices charged for each book by the supplier shall be checked with the price printed on the book or from the publisher’s catalogue / publishers Invoice.

12.  The prices should be indicated in the original currencies.  These should be converted in accordance with the approved GOC conversion rates.  Proof of the same may be submitted.

13.  In case of change in currency at the time of supply, you are requested to enclose the necessary proof to obtain sanctions at our end.  In case, price charged by the bookseller is questionable, he should be asked to present the publishers’ invoice in original / publishers catalogue as desired by the Library committee, NIMS.

14.  The supplier has to submit the proofs for the changes in prices, currencies, Authors / Editors or Title / edition of book when compared with the purchase Order with the supplied book/s

15.  DELIVERY OF BOOKS: The books should be at door delivered at NIMS library at the cost of supplier.  Transport / courier or any other type of supply will not be accepted.

16.  The supplier shall supply books as and when urgently required by NIMS.

17.  The books supplied must be physically in order.  If any discrepancy is found in supply of books, the supplier will be responsible for it and he will bear the cost if any in returning the books.  The successful supplier has to must collect the unapproved / damaged books immediately after intimation.

18.  The supplier has to agree that any Defective publications, whenever noticed, will be replaced by the bookseller immediately.  The cost of books if paid will have to be refunded to the Institute in case the publication is not available.

19.  It will be the responsibility of the bookseller to send a regular list of pending books to be supplied and bills for the books supplied from time to time.

20.  BILLS: The successful supplier has to send the typed bills in triplicate contains the list of supplied books with advance stamped receipt, publishers price proof or publishers Invoice and two G.O.C copies for GOC conversion rate.  The following certificate should be typed on the body of the bill.

“Certified that the books supplied vide this bill are not remainder stock and are latest editions.  Further certified that the prices charged are correct and those fixed by the publishers”

 

21.  The bills of successful tenderer will be passed for payment only after satisfaction of the Library Committee, NIMS and the amount will be paid within 60 days of the receipt of the bill with advance stamped receipt, proofs of price and GOC copy etc.

22.  In case the Library Committee, NIMS, is not satisfied with performance of successful tenderer, the NIMS can terminate the contract at any point of time by giving 15 days notice to the tenderer.

23.  The successful tenderer has to provide income-tax permanent account No. (PAN) to NIMS.

24.  The Institute reserves the right to disapprove any offer though it may be the lowest in rates / discount without assigning any reason whatsoever.  The approval of the offer of firm regarding rates / discount does not confer any right to claim indents from NIMS.

25.  Canvassing in any form will disqualify the tenderers.

26.  If the quotations are not in order or not properly sealed they will not be entertained.

27.  In case of any dispute or misunderstanding arising out of this agreement, the decision of the Director, NIMS shall be final and binding.

28.  Any dispute(s) arises between the NIMS and the supplier in supply of books shall be entertained by the local courts / forums of Hyderabad only.

29.  The envelope containing the Tender must be sealed and marked “TENDERS FOR SUPPLY OF MEDICAL BOOKS etc”.

30.  The sealed tenders will be submitted in person at the Sub-Dean Office, NIMS, Panjagutta, Hyderabad 500082, only.  Sealed tenders sending through post or submitting in any other office at NIMS will not be considered.

31.  The successful tenderer has to enter an agreement with NIMS on Rs. 100/- non-judicial stamp paper.

32.  The last date for availability of Tender Schedule at our NIMS website www.nimsexams.com is on  5-5-2008 by 4:00 PM.  The last date for receiving duly filled in tender form is  5-5-2008 by 4.00 P.M. at the Sub-Dean’s office only.  The sealed tenders received after the Due date and time will not be considered.
